When the City Requires Action, We Start at Any Hour

Three situations send owners to us. Each one has its own rule and its own clock.

Your situation What the city requires What we do
A facade report identifies unsafe conditions Immediate public protection; correct unsafe conditions within 90 days of filing the technical report unless an applicable extension is granted. Install protection and prepare the DOB filings we are engaged to handle.
An open DOB violation Requirements depend on the summons and may include a hearing or correcting the violation and submitting proof. Handle the site work and DOB filings within our scope.
Falling debris or a DOB order Public protection comes first. Answer the phone, then secure the sidewalk.

Your Facade Report Says Unsafe: What Happens Next

The city treats an Unsafe finding as urgent. The 90-day repair deadline starts when the technical report with an Unsafe status is filed.

Who the inspection covers

Owners of buildings taller than six stories must have exterior walls and appurtenances inspected on a set cycle.

This is the Facade Inspection Safety Program, known as FISP or Local Law 11. Buildings taller than six stories must have their exterior walls and appurtenances inspected every five years under current FISP requirements. Check DOB’s official guidance for the applicable filing cycle.

The three conditions

A Qualified Exterior Wall Inspector rates each building Safe, Safe with a Repair and Maintenance Program (SWARMP) or Unsafe.

What goes up first

For an Unsafe finding, the owner must take immediate measures to protect public safety. The required protection depends on the hazard, site conditions and applicable DOB requirements. For a street-facing facade, this may include a sidewalk shed or other protective measures. Do not wait for repair quotes before addressing an immediate hazard.

The repair clock

The owner must correct unsafe conditions within 90 days of filing the technical report. If the scope of repairs rules out 90 days, the QEWI recommends a longer timeframe in the report, and the owner can apply to DOB for an extension. DOB may grant a first extension of up to 90 days on the QEWI’s application, which must show the premises are secured with a shed, fence or other protection.

A further extension is possible for reasons such as an unforeseen delay or a hazard that needs more than 90 days to fix. Financial reasons do not qualify. This applies to the 90-day Unsafe repair clock, separate from the shed permit milestone extensions. Within two weeks after repairs finish, the QEWI inspects the premises and files an amended report.

What we handle

We install the agreed protection and prepare the DOB filings within our scope. The protection must remain in place until DOB accepts the required amended report, unless an applicable partial shed removal is approved.

Open DOB Violations: How They Actually Close

Paying a penalty does not, by itself, show that the condition has been fixed.

Three possible paths for a violation

Depending on the summons and its eligibility, the options may include contesting it at a hearing, submitting a Certificate of Correction by the cure deadline, or accepting an available stipulation. A cure is not available for every violation. The summons states whether one is offered and the date it must be done by.

What payment does and does not do

Paying a penalty does not, by itself, certify that the violating condition has been corrected. The required correction documents must be submitted and accepted, or the summons must be resolved through the applicable hearing process.

The Certificate of Correction

This is the filing that documents the correction. It has to be accepted for the correction route to resolve the summons. The filing system and requirements depend on the type of violation, so confirm them with whoever prepares the filing. A Work Without a Permit violation can add civil penalties.

Open violations and later filings

Some open violations can affect later DOB applications or property transactions. Whether yours does depends on the violation, so ask before you plan around it.

What we handle

ABC handles the scaffolding, sidewalk shed or other site work within our service scope, along with the DOB filings we are engaged to prepare. The required correction documents and the final outcome depend on the violation and the applicable DOB process. We never promise a dismissal.

Send us the violation number, building address and any relevant photos. We can review the site-work requirements within our scope and explain the next steps we can assist with.

Shed Permits Under the 2026 Rules

Sidewalk shed permits issued or renewed on or after February 2, 2026, expire every 90 days and no longer renew automatically. The standard renewal fee is $130 per renewal, subject to applicable exemptions or deferrals.

Since August 17, 2026, most renewals also need progress information on the underlying work from a registered design professional, plus a $90 progress report fee, for a total of $220. Sheds installed with a permitted new building, enlargement or demolition job are treated differently, and the progress fee does not apply to one- or two-family homes. Unpaid DOB penalties can also hold up a renewal.

ABC can assist with permit filings and renewals as agreed for your project. Our sidewalk shed page holds the full rule.

Emergency Response, Any Hour

Falling debris, a damaged facade or a DOB order does not wait for morning. Call (718) 581-4370 at any hour.

Emergency sidewalk shed permits

Sidewalk sheds generally require DOB approval and a work permit before installation. When an immediate safety threat requires a shed before the permit is issued, DOB allows the owner to install it and file the permit application within 24 hours. Other emergency work may follow different requirements, so confirm the applicable process for the specific work and site.

Emergency work during street embargoes

NYC DOT pauses most street permits on busy streets at certain times. Emergency work during an embargo may require separate DOT coordination or authorization, depending on the work and location.

How quickly we arrive

We answer calls 24/7. Response and arrival times depend on the location, site conditions and crew availability. The sidewalk shed page explains the emergency process in full.

What to Have Ready When You Call

Five details let us move quickly:

  1. The address and the borough
  2. The violation or summons number, if you hold one
  3. The facade report status and the inspector’s condition rating
  4. Photos of the wall and the sidewalk
  5. Any DOB order or cure date

Compliance Questions

Take immediate measures to protect the public, following the QEWI’s recommendations and applicable DOB requirements. Unsafe conditions must be corrected within 90 days of filing the technical report unless an applicable extension is granted. This deadline is separate from the extension rules for sidewalk shed permit milestones. The QEWI must inspect the premises and file an amended report within two weeks after repairs are completed.

The owner must correct unsafe conditions within 90 days of filing the technical report. If repairs will take longer, the QEWI recommends a longer timeframe and the owner can apply for an extension, which DOB may grant for a first period of up to 90 days. Public protection goes up immediately and stays up as DOB requires.

Not by itself. Paying a penalty does not certify that the condition was corrected. The correction documents must be submitted and accepted, or the summons must be resolved through the hearing process.

It is the filing that documents the correction of the condition behind a violation. It must be accepted for the correction route to resolve the summons, and the filing requirements depend on the type of violation.

For an immediate safety threat requiring a sidewalk shed, DOB allows installation before permit issuance, with the permit application filed within 24 hours. Other emergency work may have different requirements. Confirm the applicable rules for your site.

No. The DOB and the hearing process decide outcomes. We handle the site work and the filings we are engaged for, and we promise no result.
